Terms of Service
Last updated: October 30, 2026
These Terms of Service (“Terms”) govern your use of FlexyFlow (the “Service”), operated by FlexyFlow (“we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. Please read them carefully.
1. Agreement to these terms
You must be at least 18, or the age of majority where you live, and able to enter into a binding contract. If you use the Service for a company, you confirm that you're authorized to accept these Terms for it, and “you” means that company. The Service is made for business use; if consumer protection law nevertheless applies to you, its mandatory protections remain.
2. The Service
FlexyFlow lets you create an online store, share it by link or QR code, collect orders paid on delivery, manage those orders, and optionally take orders on WhatsApp through an automated assistant. We may improve, change or add features over time. Features marked as beta or test may be less reliable.
3. Your account
- Give accurate information and keep it up to date.
- Keep your password and sign-in methods secure. You're responsible for what happens on your account.
- Tell us right away if you think someone accessed your account without permission.
- Don't share an account between unrelated businesses, or create accounts to get around limits, trials or suspensions.
4. Plans, free trial and payments
- Plans and prices. Paid plans are offered at the prices shown on our pricing and billing pages, plus taxes where they apply. Custom plans are agreed separately in writing, and that agreement wins over these Terms where they differ.
- Free trial. New accounts can try a plan free for the period shown at sign-up, without a card. If you subscribe during the trial, your first payment is on the day the trial ends. One trial per business.
- Without a plan. When your trial or subscription ends without a paid plan, your dashboard is limited to billing and settings, and your store stops taking orders until you choose a plan. Your data stays in place; we may delete accounts that have had no plan for 12 months, after warning you by email.
- Billing. Payments are processed by Stripe. Subscriptions renew automatically each month or year until you cancel, and we charge your payment method at the start of each period.
- Changing plans. Upgrades apply right away and the prorated difference is charged immediately. Downgrades apply right away and the unused part of your current plan is credited to your next invoice.
- Cancelling. You can cancel at any time in Billing. You keep your plan until the end of the period you paid for, and you aren't charged again.
- Refunds. Payments aren't refundable, except where the law requires it or we decide otherwise.
- Failed payments. If a payment fails, Stripe retries it. If it remains unpaid, we may suspend paid features and pause your store.
- Price changes. New prices apply to new subscriptions. Before changing the price of your existing subscription, we'll tell you at least 30 days in advance, and you can cancel before it applies.
5. Invite rewards
- You can share your invite link. When someone who signed up with it makes their first payment for a plan, you earn 20% off one of your bills.
- Rewards are applied automatically to your next bill. Several rewards add up to at most 100% of one bill; any extra carry over to the following bills.
- Rewards have no cash value, can't be transferred, and don't count between accounts of the same person or business.
- We may cancel rewards obtained through fraud or abuse (such as fake accounts or spam), and we may change or end the program. Rewards already earned stay valid unless they're cancelled for abuse.
6. Your store and your customers
You are the seller. Sales made through your store are contracts between you and your customers: we're not a party to them and don't handle the money (orders are paid on delivery). You're responsible for:
- the products and services you offer, their descriptions, prices, delivery, returns and after-sale service;
- following the laws that apply to your business, including consumer protection, e-commerce, tax and product safety rules;
- telling your customers how you use their data (your own privacy notice) and having a lawful basis to use it;
- answering your customers and handling their complaints.
7. WhatsApp features
- Connecting WhatsApp uses Meta's WhatsApp Business Platform. You need a WhatsApp business account with Meta and must follow the WhatsApp Business Terms of Service and WhatsApp Business and Commerce Policies.
- The ordering assistant and order updates send messages from your number on your behalf. You're responsible for what you sell through it and for messaging customers only as WhatsApp's rules allow.
- Meta may charge for some messages (for example, updates sent more than 24 hours after a customer's last message). Those charges are billed by Meta to your WhatsApp business account.
- Meta may limit or suspend WhatsApp numbers or accounts, and we're not responsible for its decisions or availability. You can disconnect WhatsApp at any time.
8. Acceptable use
You must not use the Service to:
- sell goods or services that are illegal where you or your customers are, or that Meta's Commerce Policy forbids when you use WhatsApp;
- mislead or defraud anyone, or publish false or deceptive offers;
- send spam or unsolicited messages;
- infringe the intellectual property, privacy or other rights of others;
- publish hateful, harassing, violent or sexually explicit content, or anything that exploits minors;
- upload malware, probe or test our systems for vulnerabilities, or get around security measures or limits;
- scrape the Service or overload it with automated requests;
- resell the Service or provide it to others without our written permission.
9. Your content
- You keep ownership of what you add to the Service: products, photos, logos and texts.
- You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display and transmit it, only as needed to run, show and improve the Service (for example, to show your public store pages). It ends when you delete the content or your account, apart from backup copies kept for a short time.
- You confirm you have the rights to everything you add.
- We may remove content that breaks these Terms or the law.
- If you send us suggestions, we may use them freely, with no obligation to you.
10. Our property
The Service, its software, design and brand belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use it while your account is active, under these Terms. You must not copy, modify, reverse engineer or create derivative works of it, except where the law allows.
11. Third-party services
The Service relies on third-party services, including Stripe (payments), Meta (WhatsApp), Google and Apple (sign-in), Supabase (database and storage) and Vercel (hosting). Their own terms and policies apply when you use them, and we're not responsible for their services.
12. Privacy and data processing
Our Privacy Policy explains how we handle personal data. For your customers' data (orders and WhatsApp conversations), you are the controller and we are your processor. We will:
- process it only to provide the Service, following your instructions given through the Service and these Terms;
- keep it confidential, and make sure our staff and providers do too;
- protect it with the security measures described in our Privacy Policy;
- use only the providers listed in our Privacy Policy, under contracts that protect the data, and tell you about changes by updating that list;
- help you answer your customers' requests and meet your legal obligations, as far as we reasonably can;
- tell you without undue delay if a breach affects it;
- delete it when you delete it or close your account, unless the law requires us to keep it.
These commitments form our data processing agreement with you (as required by article 28 of the GDPR and similar laws). If you need a signed version, contact us.
13. Suspension and termination
- You can stop using the Service and delete your account at any time in Settings (cancel any paid subscription first).
- We may suspend or close your account, with notice when reasonable, if you break these Terms or don't pay, if your use creates risk or legal exposure for us or others, or if the law requires it.
- When your account is closed, your store goes offline and your data is deleted as described in our Privacy Policy. Terms that by their nature should continue (such as payment obligations, disclaimers, limitation of liability and governing law) still apply.
14. Availability and changes to the Service
We work to keep the Service available and reliable, but we don't promise it will be uninterrupted or error-free: maintenance, updates and problems at our providers can cause interruptions. We may change or remove features; if a change significantly reduces what your paid plan includes, we'll tell you in advance and you can cancel.
15. Disclaimers
Apart from what these Terms expressly say, the Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee any level of sales or results. Nothing in these Terms limits rights you have under laws that can't be waived.
16. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims about the Service is limited to the amount you paid us in the 12 months before the event that caused the claim, or USD 100 if you paid nothing. These limits don't apply where the law doesn't allow them, such as liability for fraud, gross negligence, or death or personal injury caused by negligence.
17. Indemnity
You'll defend us and compensate us (and our staff) for claims, damages and costs, including reasonable legal fees, arising from your products, your store, your content, your dealings with your customers, or your breach of these Terms or the law.
18. Changes to these terms
We may update these Terms. We'll change the date at the top and, for significant changes, tell you by email or in the app at least 15 days before they apply. If you don't agree, you can cancel and stop using the Service before then; continuing to use it afterwards means you accept the new Terms.
19. Governing law and disputes
These Terms are governed by the laws of the country where FlexyFlow is established, and its courts have jurisdiction over disputes, without affecting the mandatory rights you have under the law of the country where you live. Before going to court, please contact us: we'll try in good faith to resolve the issue within 30 days.
20. General
- Entire agreement: these Terms, the Privacy Policy and any custom plan agreement are the whole agreement between you and us about the Service.
- Severability: if part of these Terms can't be enforced, the rest still applies.
- No waiver: not enforcing a right doesn't mean giving it up.
- Assignment: you can't transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
- Force majeure: we aren't responsible for delays or failures caused by events beyond our reasonable control.
- Notices: we can send notices to your account's email address or show them in the app.
- Language: if these Terms are translated, the English version prevails where the law allows.
